Terms of Service
The plain English version. No confusing legal jargon, just clear expectations on both sides.
What Mirage does
Mirage (wearemirage.co.uk) is a web design and development studio. We design websites, build them, host them, and look after them on an ongoing basis. When we say "we" or "us" on this page, we mean Mirage. When we say "you", we mean you, the client.
The free preview
We offer a free preview of your website before you commit to anything. There is no obligation to go ahead after seeing it. It is completely free.
However, the preview remains our property until you pay for the project. You cannot use, copy, or publish the preview design without purchasing it first. If you decide not to go ahead, we keep the work.
Pricing and payment
When you decide to go ahead with a project, we will agree on a fixed price upfront. Here is how payment works:
- Deposit: A deposit is required before we start building. The exact amount will be confirmed in your quote.
- Final payment: The remaining balance is due once the site is complete and before it goes live.
- Monthly management: If you are on a monthly plan, this is billed on a rolling basis. You pay monthly for as long as you want the service.
All prices are quoted in GBP. VAT will be added where applicable.
What is included in monthly management
If you are on one of our monthly management plans, here is what you get:
- Website hosting
- SSL certificate (the padlock in the browser)
- Up to 2 hours of content changes or tweaks per month
- Security updates and patches
- Regular backups of your site
This covers the day-to-day running of your website so you do not have to think about it.
Additional work
If you need changes that go beyond the 2 hours included in your monthly plan, or you want new features or pages built, we will quote you for the extra work before we start. Nothing happens without your approval first.
Additional work is charged at £50 + VAT per hour. We will always tell you the estimated cost before doing any billable work.
Your responsibilities
To keep things moving smoothly, we need a few things from you:
- Content: Provide the text, images, logos, and any other materials we need to build your site. If you need help with content, we can discuss that separately.
- Feedback and approvals: Review designs and provide clear feedback when we send things over. The quicker you respond, the quicker your site gets finished.
- Timely responses: If we are waiting on something from you (content, approvals, access credentials), delays on your side may push back the project timeline.
Ownership
Once your project is fully paid for, you own the final website. The design, the code, the content you provided. It is yours.
If a project is not fully paid for, Mirage retains ownership of all work produced. This includes the free preview. We will not release files, code, or designs for unpaid projects.
We may use screenshots or descriptions of your project in our portfolio, unless you ask us not to.
Domain and hosting
Your domain name belongs to you. We will never take ownership of your domain. If you need help buying or transferring a domain, we are happy to assist.
Hosting is managed by us as part of your monthly plan. If you cancel your monthly plan, we will help you migrate your site to your own hosting, or you can arrange that yourself.
Cancellation
You can cancel your monthly management plan at any time with 30 days notice. Your site will stay live until the end of your current paid period.
After cancellation, we can either help you move the site elsewhere or provide you with the files so you can host it yourself.
Refunds
We do not offer refunds on completed work. If you have approved a design and we have built it, that work has been done and is non-refundable.
The deposit is non-refundable if you cancel a project mid-build. This is because we will have already committed time and resources to your project.
If we have not started work yet and you change your mind, just let us know and we will sort it out fairly.
Liability
We put a lot of care into everything we build, but we cannot guarantee specific business outcomes like increased sales or traffic. A great website helps, but results depend on a lot of factors beyond the website itself.
We aim for 99.9% uptime on all hosted sites. Occasionally, things outside our control (server outages, DNS issues, third-party services) might cause brief downtime. We will always work to resolve issues as quickly as possible.
Our total liability for any claim relating to our services is limited to the amount you have paid us in the 12 months prior to the claim.
Changes to these terms
We may update these terms from time to time. If we make significant changes, we will let you know by email. Continuing to use our services after changes are made means you accept the updated terms.
Governing law
These terms are governed by the laws of England and Wales. Any disputes will be handled through the courts of England and Wales.
